Oversize/Overweight Annual Permit Application Special Tow Truck Permit Amendment 2007 - B

This amendment is issued to temporarily alter the limits and restrictions on Annual Permits. It is applicable to all valid, existing Annual Permits that authorize the movement of a "Disabled vehicle" or a "Disabled combination of vehicles" towed by a tow truck, and must accompany the ORIGINAL permit. For the purposes of this permit, a disabled vehicle includes a vehicle that originates from a King's highway location and is disabled, abandoned, stolen or involved in a collision or unable to operate safely on a highway.

  1. By submitting a completed “Application to Exercise Special Amendment Privileges on Ontario Annual Permit 2007 - B” along with payment to the MTO at the single trip permit fees prescribed in Regulation 381/98, the privileges under clause 4 may be enacted where:
    1. The tow truck operator holds a valid annual permit issued under section 110 of the Highway Traffic Act, and
    2. The operator of the tow truck responds to the removal of a disabled vehicle or disabled combination of vehicles from a King's highway, and
    3. The vehicle has been towed to the first suitable exit off the highway, where the disabled vehicle or combination of vehicles can be safely and practically uncoupled, repaired, salvaged, or off loaded, and
    4. It is necessary that the disabled vehicle be further transported on to an alternate destination subject to condition 25 on the original annual permit due to it being mechanically impracticable to uncouple and/or tow at legally prescribed lengths and weights, and
    5. Alternate methods of transporting the disabled vehicle are not viable, and
    6. The tow truck operator can justify in writing the necessity of continuing the movement on to an alternate destination.
  2. The carrier must complete and submit to MTO the “Application to Exercise Special Amendment Privileges on Ontario Annual Permit 2007 - B”. Carriers must fax the above application to MTO at 905-704-2564. No other applications or submissions are to be forwarded to this fax number.
  3. Carriers are entirely responsible for clearance verification of the routes to be travelled, as stipulated on all annual permits and remain responsible for any and all damage incurred while operating under the privileges of this permit.
  4. This amendment is NOT VALID:
    1. If driver is unable to produce upon demand of a police officer or an officer appointed for carrying out the provisions of the Highway Traffic Act.
      1. The Operator's ORIGINAL annual permit,
      2. A copy of Part 1 of the “Application to Exercise Special Amendment Privileges 2007 - B”,
      3. A copy of “Special Tow Truck Permit Amendment 2007 - B”,
      4. Confirmation that the application has been successfully faxed to MTO at (905) 704-2564,
    2. The application or credit card information is missing or incomplete; calculated fees are incorrect; or the fees are not available on the selected credit card,
    3. The dates indicated on the application are invalid or exceed the maximum permitted travel days.
  5. This amendment may be used until December 31, 2010, unless amended by the Ministry of Transportation.
  6. This amendment, as well as any carrier's continued eligibility to utilize the privileges contained herein, may be terminated at the discretion of the Registrar of Motor Vehicles for breach of any condition of this amendment.

All other terms and conditions of the original permit remain in effect unless specifically altered by the above listed amendment(s) and/or by any previous amendments.

NOTE: Validity of the amended privileges may be confirmed by a police officer or an officer appointed for carrying out the provisions of the Highway Traffic Act by contacting the O/O permit issuing office at 1-800-387-7736 (Toronto area businesses call 416-246-7166) ext. 6306 during normal business hours.

This Amendment may be freely copied, and distributed to all holders of Annual Permits in Ontario.
